 Subject: 2004 Dakota V8 EGR question

Hi all. First time here.
I have a 2004 Dakota with a blown V8. I am buying a reman Spartan engine to replace it and they offer them with and without the EGR. Does it matter which one I buy? Not sure if the stock engine even has an EGR. We do have emissions checks in Ohio that the vehicle must pass in order to register the vehicle. If I get the engine without the EGR, will it pass the emissions check?
Any info/advice would be appreciated.
