Josh - Good luck with your troubles. As chief union steward where I worked, I'd see a lot af favoritism and abuse. One guy was tested because someone claimed he looked like he was snorting something, tested that same day and flunked for pot and fired. I argued you don't snort pot to show there wasn't a reason to test, but couldn't do anything about it as he was a probationary employee. The pot smokers seem to get the short end of the stick as they can test positive for a month or more after use; while those using hard drugs usually test clean after about a day -usually getting away with their more dangerous habit. I hope that was the case with you. Some contracts have a clause where someone who tests positive is off for so long on a first offense, then returned to work after completion of some sort of rehab program - you might want to see if anything like that is in your contract. I know how you feel; I'm out of work myself after being illegally targeted for my union activity and having my job title included with a layoff of 24 less senior employees who were identified more by department than job title. Management insisted that it was just a business decision, but you should have seen the long faces on their side of the table when their lawyer agreed to have my arbitration expedited as he understood the seriousness of our charges. You never know how an arbitrator is going to rule; sometimes its more arbitrary than it should be as some will ocassionaly rule for the side they haven't ruled for in a while so as to appear impartial. I should have a pretty good shot at reinstatement, so you'd think they'd want my arbitration heard sooner to limit what they will owe me for time not worked if the decision goes my way. We have a few very anti union people who post here sometimes; don't let it get you down if they chime in on this. While unions can sometimes be abused, people should realise its unions that have brought better working conditions for all. You'll get through this somehow, hang in there.

I got a phone call from A person that I think I know but not for sure .They left me a number to call and talk to this lady.It ended up being A wife of another employee.IT STATES.(I Jennifer..... was maried to Robert ......Threw the years 1998 threw 2000 At wich this time before and after worked fow NWS of Michigan.During the period we were together bob took a random drug screening wich he did not Pass.He was good friends with the supervisor in and outside of work at the time.He was repermanded for the possitive testing and could not drive a truck any more but was still employed and to my knowledge is still presently employed with mws at another NWS Location as a drive. She took the letter and had it Noturized and is in a very proffesional manor.I am turning this letter into My steward and Teamsters President.I balieve this is discrimanation on there part.I called Larry my plant manager read him the rough graph of the letter he now wants to talk to me today at 2 oclock hopefully to cut me a deal maybe they think I got them .As a steward what is your opinion on that letter Mr Kowlaski?She is willing to testify for me at arbitration also.

Definitely a point in your favor - we always argue for fairness. It's only right that if they make an exception for one employee, they should make it for others. I'd suggest calmly presenting the facts at that meeting, and with a union steward present. Act very respectful, and don't get upset no matter how it goes; that only gives them something to use against you. I hope the meeting goes well for you; let us know.

Well the meeting was a bunch of bull.When I handed that sworn document to the facillity manager he looked like a puppy getting ready to get kicked.I ended up requesting to speak to the C.E.O of the company and he wasnt gonna back down for sure.But it comes to find out he new nothing of this other incident that was apperently hidden and pushed under the rug buy Larry (Facility Manager)and Arnold (Drivers supervisor)Trying to cover for there friend(BOB)the driver that failed his random and Kept his job after some Drug councelling all three were golf buddies from when the State owned the Liqure.i BALIEVE AND MY lOCAL 337 President and my steward balieves a company should be acountable for there Manager and supervisors mistakes.We are going for discrimination and the first fact another fella hit the sprinkler systems with a cheripicker(stand up hi lo)causing massive damadge and was not tested like myself.

As for Todds question I once was a heavy POT smoker probabley 10 years I checked myself into a DA Class to get help almost a year ago after 3 months of that I was clean and didnt wont to end up Like alot of the folks in those meeting.I was clean for about 7 months in september I got a call from back home (Pekin Illinois)that my grandmother had past in her sleep.The three days I was there I was with familly and friends I havnt seen in some time (being I have lived In Detroit 12 years now)and I made a mistake.I smoked and drank the nights away while I was there no Kids No wife (Stayed Behind)just me and my thoughts of the Biolagical family I had left behind and missed the last 12 years of there Lives and I got deppressed.When I returned to Michigan I found myself craving the drug again.I went back to Wyandot Hospital and attended my NA classes on Wendsdays again Thee weeks into them and drug free this door on the trailer vibrated down anough to hit the top of the mast on the front of the hi lo.And this is were I stand right now I didnt hit a mans foot I didnt lift it up so hi it took out the sprinkler systems and I wasnt randomed there worn out door fell on my Hi Lo cause the rollers were bad and rusted and would not lift it up as far up intp the traxs as was supposed to. on So I understand every action has a reaction and I should of thought of my wife and kids in Michigan instead of acting like a little kid.But I will be treated the same as anyone else in a Union shop and I will not be discriminated against.SO Did I mess up TODD YES!Was I given A second chance Like bob was cause the supervisors were old friends NO!Theres alot more to this guys a black man out in the warhouse I work ran a mans foot over with his Hi Lo accident off course butt was he tested for inflicting bodily harm No!
