Subject: Speeding Ticket

Have a question on behalf of my wife; She was nabbed today for doing 42 in a 25 zone in a residential area. What I’d like to know is what is the best course of action. Pay the $150.00 fine, or go to court to hopefully have it reduced/thrown out. Also what are the ramifications toward our insurance (First ticket we’ve had in 20+ years of driving) We live in Fayetteville N.C. Any suggestions would be greatly appreciated

Unless someone was dying or giving birth, why in the hell was she going 42 in a 25? That comes out to 168% of the speed limit. HOLY HELL is all I can say to that. If this was your first mistake I'd say be honest and talk to the judge, but not getting a ticket and not getting caught are two different things. If she just hasn't gotten caught all this time, she deserves every penny of that rather small ticket.

My suggestion, don't go so fast, especially in a residential area.

The residential area was a 35 zone about 6 months ago, wide streets, little traffic, it was an honest lack of attention to detail, she's never been a speed demon

Then there is your explaination- take it to court, talk to the prosecutor ahead of time and they should reduce it to a non moving violation.

yeah it is. They'll hit you for more on the fine + court costs. Its all about money. I once had one like that and I was gonna loose my license if I got any points and they said they'd reduce it from 4 to 2 points and no more. I said how bout if we double the fine? I walked out $300 in the hole but no points.

Hey, not to be a jerk, but just pay the fine.

It's not that much and your wife was going dangerously fast in a residential area.

Cop probably gave her a break on the speed, cause if the ticket was for 45mph, it would have been reckless driving.

Chaulk it up to experience and a lesson learned.

To tell the truth, I have no problem with paying the fine (she does deserve to pay it) I'm more concerned with points as they pertain to our insurance, hate giving them any more money than i have to.

In Texas and many other states, the law provides that you may take an approved defensive driving course and have the ticket "expunged" (Never shows up on your driving record).

I would definately go this route. The overall cost will be about the same as paying the fine.

Yeah, there is a problem with insurance companies. Even you you learn your lesson and pay up for the fine, you'll pay that fine every year from the insurance company. Can you pay a ticket witout the insurance company finding out?

I'm not sure how it works in the States, but here in Canada there are a few companies that will actually "fight" your ticket for you. Usually they are people that are ex-cops and lawers and stuff, most of the time they will either get it taken away all together or make it so you only have a fine (no points!). Check into that, I've used it and love it. Also, check the ticket for anything that may be false, ie. wrong time of day, street, car, name miss-spelled, etc. anything that can make the ticket "invalid".

Just some things to think about. If not, pay the ticket, sounds like she's guilty.

i got a ticket when i wasnt speeding (cop pulled over the wrong car)... the prosecuter believed me and offerend me deferred adjudification (sp?). everyone else got 3 months probation and $150 fine and he just gave me 1 month of d.a. and a $100 fine.... basically they just want money.

I was doing 90 or so in a 65 last Sunday morning, a red nissan had passed me and I was tryin to get back in front of her. We went under an overpass and all of a sudden she stopped racin? Then I saw why. Once I was pulled over, the officer asked if I knew how fast I was goin, I said I was going with the flow of traffic, LOL :-) He told me to be more careful and gave me a warning. That won't happen twice in a life time. WOW

I got pulled over doing 52 in a 35 on a Saturday night at 1:30 am in Charlotte, NC. I knew the speed limit was 35, and when the cop came up and asked me if I knew what the speed limit was, I lied and said "Yes sir, 45 mph." I figured if HE thought that I really thought the speed limit was 45, then 52 wouldn't seem as bad as if I admitted I knew it was 35.
So, long story short, he gave me a stern warning and let me go on my way.
I attribute this to the fact that it was a Saturday night (sunday) at 1:30 am, my truck was all legal and immaculate inside (I had cleaned an vacuumed it that afternoon) and I was completely sober............and he was in an area that normally would have got him a DUI or drug arrest easy.
He had bigger fish to fry that night I figure.
Lucky me.

My wife told me that the cop was incredibly nice to her, however he obviously had no trouble with giving her the ticket.
Can you talk with the prosecutor prior to the court date, or do you have to wait and find out what kind of a mood he's in???

I'm sure he was very nice to her. Cops generally are if you don't give them a hard time. Probably why she got out of the reckless driving. I've been pulled a few times in my life, and the cop was always very nice.
Odds are if you haven't had a ticket in 20 some years, you won't get any points against you.
I've never had my insurance raised by 2 tickets over 12 years.
If you really want to fight it, just go before the judge and tell them you're wife hasn't had any driving infraction for 20 years, and chances are he'll just let it go. Not like you robbed a store first.
Be honest, pay the fine and get a good nights sleep. My .02...again...lol

jsut pay hte ticket i just got my 5th one the
other day. 48 in a 35. where jsut about every one
does 60. its was 3am. jsut pay the ticket. this is
my 5th one and (knock on wood) none of them have
caught up with my insurance. your insurance
company is not directly notified of your
violation. however if they chose to look into it
they can. thats when it hits you. so jsut pay the
ticket. your only other real hope is that the cop
doesn;t show up

If you haven't had any ticket in 20 some years, like I said, pay and forget about it. Go to court if you feel better. They will throw it out.

You can always demand a jury trial or you can go to traffic court and when your found guilty, you can appeal the decision to the next higher court. For what it would cost the city to do either of these things, they would most likely dismiss it to avoid you and your "crafty knowledge" of the legal process.

Look, Gary, one more time, DO NOT try to talk to the prosecutor ahead of time, DO NOT pay the fine. You call the number on the back of the ticket say you want to plead not guilty. Go to the courthouse on the date of the trial, talk to the cop and the prosecutor ahead of time, they will make a deal with you- non moving violation- like they said- big fine (prob about $150)which you will be glad to pay because in the long run the insurance costs will amount to a much bigger fine. It is all about money talking and BS walking, sad but true, been there, done that. Added bonus if the cop don't show up like Greg555 said they might throw it out, but whatever you do do not NAG the prosecutor, you will wind up paying for it.

Just keep your wifes speed in check. 42 in a 25 isn't an accident.......mabey she was "losing attention to detail." She shouldn't be. Give her a refresher on driving skill. My kids are at risk.

Well, back in the day, I got caught drag racing. In Wayne County, Michigan, where I live and the ticket was issued, this is considered a misdemeanor. The penalty for this charge would have been up to $1500 fine, 91 days in jail, impounding of my truck, 6 points on my license, and a 6 months suspension of driving privledges (sp?). I chose to fight the ticket, even though I knew I had raced. The cop actually had it on video. (Wayne Co. does racing stings every summer, more on that another time). I set up an appointment to speak to the prosecutor. We sat down and talked for about an hour. The prosecutor must have like my attitude or appearance or something. She said that the officer said I was very respectful and he noted that I did not try to run or flee. Most drag racers in our area do, but get caught. The cop did show up to court and actually spoke in my defense. All told, the judges ruling sounded something like this, "In light of the conversation I had with the prosecutor and the officer, I am going to reduce the charge to Too Fast for Conditions. This charge carries an $80 fine, and normally carries 2 points, but I will waive the points. Mr XXXX, how do you plead to Drag Racing?" ME:"Not Guilty." Judge:"In regards to the charge of Too Fast for Conditions, how do you plead?" Me:"Guilty." Judge:"Very well, the fine is set at $80 with no associated points or restrictions."
Sorry for the long post, but it's worth your while to at least contact the prosecutor once! Good luck

ya go 42 down my 25 mph street and the neighbor 3 doors down will lay in wait for ya, then use #9 shot to sandblast the paint off your car/truck he's had 4 hits since last month. If ya hit one of the many kids on the street, you can't drive fast enough to get away from us all.

Going to court doesn't cost taxpayers money, it makes them money. When the reduce the points the increase the fine and the hit you for abot $35 in court fees. Also I don't know what insurance company doesn't find out about points but please give me their name.
