Hey yall, I own a 97 4x4 Dakota and its my favorite toy. Last night I was at a Static X concert in Des Moines, Iowa, and I was one victim of a joyride in the parking lot. Some @#$% head took his caprice for a hit and run fun time in the parking area. My truck was smashed in the rear, a 2000 mustang was prolly totalled, and others. The cops have the owner of the car in the patrol unit, got his insurance info, and now we have that.
So where do you go from here. The kid lied for about 2 hours about it in the rain...urrgggg....but I want to get out of this mess without paying for anything here. I have all his insurance information from the police report...is that all I need. Do I just get estimates and get it fixed? Or get estimate for all new parts, then get the $ then get it fixed?
I've never had this happen before...can anyone else guide me in the right direction. I love my truck, as you all do too....why the heck did he hafta hit the nice ones???

Call your insurance company and provide them with the information on the police report, they should then tell you what to do. :0)

When I got rear ended, I called my insurance company and simply told them I'd been in an accident and had the police report. They asked for the report number, the township, then told me to take it for an estimate. Ask your insurance company if they have a 'prefered partner', and if you've heard good things about the partner, go there. They typically get the money faster. In my experiance, the insurance company simply faxed them an OK, they fixed my truck, and they settled with the insurance company directly. No fuss

This is what worked best for me the last 2 times I was hit where it was someone else's fault:

Call HIS insurance company ASAP. Make sure they know that he caused an accident, and get your information into them NOW. Insurance coverage gets paid out on a first-come, first-served basis. Once the insured's limits are hit, the insurance company stops paying. Because this guy was a complete idiot you should assume that he does not have the highest insurance coverage, and may not cover all of the vehicles out there.

If you file a claim with your insurance company, they will pay for all of the repairs and then go after the other guy's insurance company for reimbursements. If they can't get paid because the funds have dried up, they're stuck footing the bill and your record will typically reflect that. Many insurance companies will actually put the ding on YOUR policy until they are paid back, then they'll file it as paid.

They're not supposed to do this, but I've found that some insurance carriers will treat you differently if you've had lots of claims even if they weren't your fault.

The way to get your truck fixed properly with the fewest hassles would be to have HIS insurance company give you a list of recommended body shops in your area. Arrange to go to the one that seems the best quality if they're open today, or first thing monday/tuesday depending on whether they're closed for the holiday. Have them prep the estimate for repairs. Since you were referred to them by his insurance, the billing should already be arranged to be paid by their company, you shouldn't have to pay a dime to get it fixed. His insurance company should also pay for a rental car while yours is being fixed.

Keep in mind that should be the way to get your truck fixed with the fewest hassles - you could have his insurance company come and inspect your truck and sometimes they'll cut you a check for the repairs, but this could end up being good or bad for you... Rear bumpers are very pricy, many people with Daks who get rear-ended end up getting more $$ out of it than the repair costs, especially if they replace it with a roll pan or a used bumper. Then again, if the check they cut doesn't cover the actual repairs once you have them done, it's usually a pain in the ass to get more money from the insurance.

Either way, don't waste a second of time getting your truck inspected by an insurance representative (whether yours or his) and get it in for repairs ASAP. This is a case where it would be in your best interest to get it done and over with as soon as possible. I was able to process both of my recent accidents (in other vehicles thank god) very fast without any problems because I made his insurance arrange and pay for it all.

I agree with SinCity R/T. One time I was waiting at a stop light and had some stupid $*&#%^ high school student cross over the double yellow line to go around me to get into the turn lane, she didn't go over far enough though because her mirror broke my tail light and left a small crease in the side of my turck. She didn't even stop, I had to chase her to her school and finally she stopped there. Anyway, I didn't even have a police report, I just had her insurance info and policy number and called her insurance company and told them that I needed to make a claim on her policy. (this was after she agreed to pay and didn't) They had me come in to their estimation office and I got a check for the entire amount 3 days later. (About $700.00) Her deductable was $500 though so she got stuck with it anyway!
