Okay i got a SICKKKK azz dual Flowmaster exhaust on my new 2000 Dakota RC truck.

Its an awesome looking custom job that the previous owner had put in and i really like it and i get comments daily on it. However.. my landlord has $hit fits about it. For all i could care he can shove his head up his azz ( hes gay so he might like that though) but he just served me with eviction paper over it. Now the truck is well below ticketable DB levels but i mean come on... Dodges are not quiet. (he states in the eviction notice that he wants it made as quiet as his Hnoda Accord HAHAHAHA)

So my question to everyone here is:
Has anyone delt with this kinda BS before?
Any legal facts or 411? I am in Calif
possible exhaust silencers and prices?

Basically legally he has no ground to stand on on this. but i just want to present the facts to him and tell him to fcuk off. Any ideas? any vulgar comments about my landlord would be appreciated : )
Thanks
Lizardking

If the exhaust passes the sound check, then I wouldnt worry, but you could get ahold of an attorney and ask if the landlord could really evict you for this, I really doubt that he could. Your truck is legal, you pay rent on time. To Hell with him. He is actually being prejudice of you and your truck, serve him for this.

Well first i would say talk to an attorney first, second have a test done to make sure it will pass noise ordances, keep making rent on time, and then i would tell him that if he didn't drop the eviction that you were going to sue him for eviction because of discrimination. thats what i would do. just my two cents

If you have no lease, you are out of luck. If you do have a lease, you should take a look at it, specifically for any clauses referencing grounds for eviction. Your landlord may have retained the right to terminate the lease at his discretion if you prove to be a, for lack of a better word, bad tenant. Generally, the specifics of this, or what constitutes a "bad" tenant, are spelled out. If the lease does not enumerate grounds for eviction, you may have the ability to sue for breach of contract, as it does not prohibit your actions (or those of your automobile). If the lease prohibits "unreasonabe" noise on your part, then you are in breach of contract, and if the landlord deems this breach material, then you can be evicted. Whether the noise is "unreasonable," however, is a question for the courts, and again you could technically sue your landlord. If I were you, I would carefully read my lease and consult with an attorney.

Gee... in Vermont it is well known that it is AGAINST THE LAW to evict anyone during the winter.

Somthing about children freezing in a snowbank that can get landlords in trouble ;-)

Many low-income folks simply stop paying rent in the winter KNOWING they cannot be thrown out... in the spring they just quietly move to another apartment to start the process over again.

If you were in Vermont... you would have a couple more months before eviction can be exercised.

I once had a 4 cylinder that I blue printed and set up for raceing. The valves did not float until 10,000 RPM's. I would shoot through the main drag in my city at 2:00 AM and hit 9500RPM and the windows in all the gas stations would resonate and dance. Alot of the thrid shift attendents told me they thought the windows were going to break when ever I came through town. It also used to set of car alarms alot. I was running a huge thrust glass pack intended for large modified V8's. lucklly at normal rpms it did a decent job but one I went past 6000 RPM's it acted like an amplifier. I would try ideling past your landlord!

Dude, go in his front yard and do a grass burn... You know, slam the brake and gas and dig him a couple of nice holes. Oh, and let that dual exhaust rip man. Or tell him you dont like his complusive need to boss people around.

What exactly does your exhaust include? I'm assuming mufflers are not included. And where does it exit? I can't see in the pics. I'd think that it's illegal to evict you for it, unless you just leave your truck running backed up to his window every night. I don't see how he can evict for a few minutes of sound every day. I'd call a lawyer too.

LOLLOL... i love all the feedback i am getting and i have talked to 2 Oakland Police and a Highway patrolman. They all came over and commented on my nice truck and basically laid down the law saying that if i was revving the truck in the neighborhood at 3 am and one of them saw me that i would get a warning and then a ticket. But they agreed that rolling into a parking space and quietly turning off the engine it within perfectly acceptable levels. I mean i have set off car alarms before when revving it up a hill.. and yeah... its LOUD. LOL
And if he does succed in making me find another place.. I can assure you there will be a few 3 am max RPM test sessions that I will be performing in his driveway. I think he is just jealous my truck is better than his.
oh well.. i will keep everyone updated on this "DodgeGate Scandal"

I have a 92 3.9 with duals and no mufflers, it's pretty loud, I can probably compete with most V8s in volume but not tone. But I can't see people getting evicted over it. I don't get many complements but I do get a lot of looks and people trying to race me. Kinda Fun really. We have a local "drag" where hundreds cruise every weekend and it easily reaches the thousands during the summer. It's cool because there are 4-6 story buildings on both sides for like 4 blocks and the echo is awesome. I go out of my way just to go up there, people get Pi$$ed, it's funny. Don't do anything to the pipes, just make him suffer.

You could of course just grow up and move. Buy yourself a large farm or ranch, then you can make all the noise you want.

But, if you can't afford to indulge your bad behaviour in the privacy of your own property, learn to live with it. You don't have the right to try and make others put up with it.

Grownup when did this guy say he was being bad? How do you know that his landlord isn't just a nitpicker? Or just one of those people who has nothing better to do than complain. My neighbor hates every vehicle my family owns a couple of weeks ago he blew all of the leaves out of his shrubs and driveway and intentionally blew them UNDER my truck which he saw me wash and polish the day before. I even live on my own residence, you have no reason to make that kind of judgement.

Anywhere near Sacramento? Some 400 people just got evicted by one owner at once. (he owned almost all the houses in a few neighborhoods) They think it was because they were complaining about the lack of repairs and the owner was taking revenge.

Sometimes people are just pricks.

my .02...First of all, unless you are being obnoxious by creating unnecessary noise (that would be the 2-3 am burnouts) the chances of you getting evicted are slim and none. Of course if you are not exactly the model tenant, that is different. I'm giving you the benefit of the doubt. I say let him try and tell him if he wants to cry, you'll give him something to cry about...politely tell him that if he is going to file eviction papers, you are cordially going to withhold you rent payment pending the outcome...and then tell him to bite you where the sun don't shine!!!
