Subject: Has anyone used Lemon Law?

Just wondering if anyone has had to enact the Lemon Law with their Dakota? My 2 month old 03 CC 4.7L has had the check engine light come on twice. First time the computer had to be replaced. It may be the same thing again. Will find out Monday as the dealer said they were "too busy to get to it today". I also have standing water on the passenger side floorboard. I've studied the law in my state (FL) and know that the same part has to fail at least 3 times or the vehicle is out of service for a cummilative of 15 days. Just wondering how Dodge handles these claims and if anyone has any stories good or bad?

My friend tried to do a lemon law recall on a dodge ram truck. it took him the better part of a year and quite a few bucks to get them to buy it back.
Some states are a little easier than others but the manufacturer will fight you on the buy back. they dont want the truck back either

The lemon law is a peace of crap, it protects the dealers more than the consumers. I had my catalytic converter replaced 5 times and less than 2 years. Then I found out that the No Lemon law only effects the vehicle the first year of purchasing and there is NO "no-lemon" law on used vehicles. It sucks, my truck was only 1 year old when I got it. Needless to say, I have not had any real problems other than the cats, but still the dealer ship just said we'll replace it untill the warranty runs up, then its all on you.

I've never heard a positive story come out of a Lemon Law encounter. They were all tales of woe and torment, stretching into months and months of back and forth, delays, hassles, you name it. Be prepared for a major battle if you go this route. But, if the truck's a lemon, I'd go ahead with it. Just go into it knowing that the manufacturer will fight you and use whatever tactic they can to get you to drop it or give up. Here's a thread you might look at concerning a guy with a Ram who's thinking about taking the same route. You might need to register to see it, but it's a good site...

As for the water on your floorboard, join the club! See the thread on this board "water found on pass floor board! help" This is a common and ongoing problem, I just found it in my truck yesterday.

lemon law in california works very well...my
fiancee had a VW golf, it had numerous
problems (check engine light 15 times)
eventually they bought the car back. all you
have to do is follow the right steps and it
works pretty well. all in all it took about 4
months for it to fall through, but a very
painless process, no money involved and
(thank god) no lawyers.

another section of the lemon law which most
people overlook is the "30 day" part. if you car
or truck is less than 12 months old and has
spent a total (including weekends) of 30 days
in the shop, it is automatically a lemon.

my advice to you, contact a lemon law attorney
and ask them their opinion. if they feel you
have a strong case, I would go for it.

Lemon law works well in NC. I went with the Dispute Settlement Board with Ford on a 2001 Taurus with a bad tranny. It was in the shop 53 days. To qualify for lemon law you MUST have been to the dealer for the same PROBLEM 3 Times. Keep your service receipts and keep a log. Trust me it WORKS. I got my car payed off, plus all payments made, interest, and the down payment back. Any questions let me know.

I have a positive story concerning the "lemon-law." I was able to get the Ram that I wanted because it was bought back by DC, in which a small dealership purchased the truck and re-sold it to me for a few thousand less than NADA, and Kelly Blue Book.

The truck had only small problems within the first year of ownership which included, a small transmission leak, a leaky powersteering line, a "bad" key (the microchip failed), and squeaky rear shocks.

All of which were fixed (and documented), and I've driven the truck for over 4,000 miles with no problems. I love the truck, and it's still covered under warranty!

So I guess I'm one positive outcome concerning the "lemon-law" woes of other consumers. However, I realize that there are "horror" stories out there concerning trying to get a vehicle bought back.

In fact I know of a family that purchased a Subaru Forrester, and has had the car back to the dealership several times (more than 3 times) for a water leak in the passenger compartment. They've tried to get Subaru to buy back the car, but they are told that "Subaru doesn't buy back their vehicles." I told them to contact a lawyer, for there are steps to take to get the satisfaction they deserve for the amount of money spent on a vehicle.
***It's funny though, their Subaru is a 2002, and Subaru has introduced a 2002-1/2...I wonder why? Could it be problems with the 2002? I'm willing to bet on it!

I used it here in Florida and it worked.Truck 2000
Dakota 4.7L was in the shop over 27 times for the front end,Even had the wheel come off any hoo,The truck had less than 12,000 miles on it over 18 months,When the Factory Rep Test drove it,he told me it wasn't safe and i could have a replacement truck from the butthole Dealer or a Check in ten days,I took the Check,Once you File The Lemon Law in Florida it Kills All Warranties on the Veh.
The Vin Number for that truck was 1B7GL22NYS527922 SO RUN OUT AND CHECK YOUR VIN'S

I bought a buy-back. 99 CC 5.2 4x4 dakota. I have had only small problems with it, including my popping in the front end which the dealership said they could not find out what it is. But anyways, blue book when I bought the truck was 19,680, and I got it with an extended warranty, after 2 days of haggling for 15,000. I have a 1-year unlimited mileage warranty for it being a buy-back (which is 3x better than any warranty that you can buy) and then I have my other after that for 3 years, 48,000. I never knew there was money out of your pocket with normal warranties, but with the buy back its not...

Great truck!

I'm glad to see that all is not lost when trying to get a vehicle declared a "lemon". Glad that it worked out for you guys. I've known one guy with a Silverado and another with a Dakota who went through months of back and forth with corporate. In one case, the guy would document his problems, get the dealer to vouch for him, then wait weeks, only to hear that his paperwork had been lost, or his case rep had changed, and they had to "familiarize" themselves with his case. One rep would tell him that they were getting close to making a determination, and then 2 weeks later, they'd need a bunch of extra documentation, or backtrack to do things over that they'd already done! It was a mess, they were just trying to make his life so difficult that he'd give up. He finally did get a new truck, so maybe it was worth it for him.

If the truck is junk and meets the lemon law criteria, I'd do it myself, even knowing that it might be a royal pain for the next year. I also believe that how well the process goes depends on the company, how they view themselves, how objective they are, and how much importance they really place on maintaining a good image and actually offering good customer service. I just hope that I never have to find out for myself.

I know a guy who had his Chevy 1500 lemoned, then had Dodge buy back his Off-Road Ram or whatever special edition it was. He got a brand new Ram 1500 and hasn't had any problems. The dealership then sold that Ram to some poor shmuck. He complained to DC and somehow the local dealer bought the piece of garbage. No idea how that happened. The doors were soo crooked from the factory you had to jump into them to get them closed.

I went round and round with them about buying my POS 02 ram back, I just finally said screw them and traded for an 02 Ford. The Ford is so much better than that dodge POS, I'm pissed at myself for not buying Ford in the first place.

I had problems with my 2001 Dakota Sport Plus. The problems really were not that bad, but the dealer used any lame excuse they could not to repair anything. I tried the talking with Daimler Chrysler (DM), but they felt they were doing me a favor by "buying back" my truck....

To make a long story short, go to the attached web site, I used them, I received a new 2002 DAK, and DM had to pay alot more money then if they would have just repaired the original truck. I love my new truck now, but will most likely never buy another car or truck from DM since they were such @#$%^&**$#%...

Chrysler responded very well for me in NJ. Mine was in for oil leaks (and an inept dealer who did not do repairs as reported and failed to replace the correct parts twice). NJ has a free help service who told me to do and an address other than the one listed in the Chrysler handbook, where to send a certified letter to and not to talk to the dealer. No lawer in volved. I had a Chrysler rep call me right away and they installed a new short block at 16k rather than take the chance of having to buy the vehicle even though the the second dealer where I wanted the the motor installed at found right where the oil was coming from.

Michigans lemon law is very painless, I strongly recommend reading your local lemon law completely and make a decision soon. You could always pull the dash cluster, pop the engine light and sell it to some poor shmuck! Unethical? Maybe... depends if you believe selling a brand new truck with a design flaw and not admitting it ethical.

Just an update on my situation. They fixed the water on the floorboard and replaced the carpet. Now I'm fighting Check Engine lights. They have replaced a soleniod and my gas cap but I am still getting the light. Next Monday will be day 9 of my required 15 days out of service before I can start the Lemon Law process. I really hope they can fix it because I really like the truck, but, I won't hesitate to get rid of it.
