OK, here's the quick scoop. I got busted yesterday going 86 in a 65 even though I know I was only going 75 in a 65. The cop didn't want to hear it and my radar detector never wnet off, was he really radaring?

So I am going to fight this. In the last 3 years I have the following, Can I calim good driving record?:

Jan '03 I was rear-ended, 100% not my fault as I was rearended and did not hit the guy in front of me.
Nov '01: Window tint violation (non-moving of course).
Sept '00: Failure to yield to something, basically a right on red (told this was a non-moving violation as well).

I can handle the ticket, he lowered it to 80 in a 65 so I could mail it in if I wanted. But I don't want my insurance to skyrocket. I turn 25 this summer so I was looking for it to go down.

The violation happened in RI and I live in CT. so if I pay the ticket what are the chances that the insurance will not find out about it (this happened on 3 tickes i received in HS / college).

Other wise what should I use as my defense, jsut state my case or go the route of requesting certifications on the gun, the officers training etc.

Someone on this site has to knwo how to beat a ticket. I definitely learned my lesson on this one and will slow down overall so please help me.

my girfriend went to protest a ticket she got. the trooper never showed up for the hearing so the ticket was trown out. this is in virginia. i'm not sure what the procedures are in your neck of the woods.

Thanks man... I am thinking that may happen as he specifically told me that he lowered the speed so I could mail it in as opposed to having to go to court... But I don't want to have to bet on that....

Why not find out if RI allows you to take traffic school?? If so, most places now allow you to take an online course. If you actually read the lessons, the online courses take about 3 hours. If you skip straight to the tests, you can be done in 1/2 hours. Find the right online school site that RI will accept, and they pretty much give you the answers during the test. I've done this on three different occasions in Cali and my insurance never went up after a ticket.

After talking to my brother, (a local police officer) he said you're screwed if he got you radar. If not, then he has no case. also another way of getting away with it is to fight it in court and hope he doesn't show up. if it was a trooper, they have better things to do then to fight tickets in court, a local police officer will most likely show up, unless it is his day off.

It was a state trooper. So I do doubt that he is going to show up. What about asking for the certifications on the Radar calibration, the officer training, etc? when do you file for all of this, the day you go to court or just a couple days before?

Also what about the fact taht he put radar on the ticket but my detector did not go off. After he gave me my ticket he went about 3 miles up the road and my detector went off big time while he was sitting there. Long before I ever saw him. So he either clocked someone else or jsut guesstimated the speed and put down that it was Radar.

Plead not guilty, and let them schedule a court date. When you go to court, ask to speak to the prosecuter. 9 times out of 10, all they want is their money, and will be willing to reduce it from a moving violation, to a non-moving one, with the same fine.

You shouldn't have any trouble, as long as you currently have no points on your license.

Chris, call them first, and notify them of your intention to plead not guilty. That will save you from having to make the trip twice. They'll give you a new court date, anywhere from a few weeks to a few months, later.

The Radar calibration and operator certification aren't good ploys anymore. The new Radar guns are self calibrating, and get sent in yearly for testing. All officers are trained on their use as well. What are the laws in RI for radar detectors?? You might not want to tell them you had a radar detector that didn't go off. That might lead to another fine, and then pretty much guarantee a conviction. If you don't speed, then why have a radar detector?? And in Cali, the cops can "pace" you and it will hold up in court. No radar needed. It's your word against his, and the officer is always right unless you have other proof.

So then my options are as follows:

1. claim good driving (as long as the accident and non-movings do not affect me)
2. pray trooper does not show up
3. clain not guilty and explain my case and pray or
4. hope it gets reduced to a non-moving and pay the price

Did I miss anything? well otehr than jsut paying the ticket.
